What activities need to be licensed? In England and Wales, it is unlawful to do the following without a licence: 1) Sell alcohol at any time (“the sale of alcohol”).
The type of licence that you need to lawfully out any of the above activities (“licensable activities”) is called a Premises Licence. A Premises Licence is a licence which authorises the premises to be used for one or more licensable activities. The types of businesses and organisations that need Premises Licences include: •Pubs and bars, Cinemas, Theatres, Nightclubs, Late-opening cafes, Takeaways, Village and Community Halls, Supermarkets
You can apply for a Premises Licence by submitting an application form to your local council. You will need to pay a fee for the application. You will also need to submit a document called the “Operating Schedule” with your application, which includes a statement of the following matters: •the licensable activities applied for; You will have to give notice of your application for a licence by advertising it. Where no representations (objections) to your application are received by the Council ,your application will be automatically granted. However, where relevant representations (objections) are received, the Council has to hold a hearing to determine whether or not to grant your application.
When determining whether or not to grant a Premises Licence, the Council will always take into consideration the impact that the licence might have on the following factors: •Crime and disorder. 범죄와 무질서 The applicant will need to satisfy the Council that it will put measures in place to ensure that the above factors (“the licensing objectives) are not negatively impacted. At a licensing hearing, the Council may hear objections from the Police, the Fire Authority, local councils, local residents, local businesses, and any other relevant persons.
If a Premises Licence is granted, it will have effect until it is revoked or a specified period.
In order to sell alcohol, in addition to a Premises Licence, there must also be a person present on the premises with a Personal Licence. This will usually be the designated premises supervisor (“DPS”) who has the day to day responsibility for the running of the business. The DPS must be named on the Premises Licence and will be the primary contact for the Council and the Police. They must understand the social issues and potential problems associated with the sale of alcohol and also have a good understanding of the business itself.
